This Privacy Policy (this “Privacy Policy”) of Colados (“Company”, “we”, “us”, or “our”) describes how and when we collect, use, maintain, and share your personal information when you interact with our website, our mobile applications, our affiliated network of websites, our emails, our SMS messages, and any other interactive features we may provide (collectively, the “Services”).

When using any of our Services or by purchasing our products, you are consenting to the collection of Personal Information and use practices described in this Privacy Policy, as modified from time to time by us in our sole discretion. You consent to our collection, use, and disclosure of your information as described in this Privacy Policy.

PURPOSE OF INFORMATION COLLECTION AND USE

We collect and use your information to provide, measure, and improve our Services over time.  For example, we may use the Personal Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our website (for example, by generating analytics about how our customers browse and interact with the site, and to assess the success of our marketing and advertising campaigns). We may also share or disclose your information for purposes required or authorized by or under applicable law.

INFORMATION WE COLLECT AUTOMATICALLY.

When you interact with the Services, certain information about your use of our Services is automatically collected. This information includes which video(s) you watch (if any), when did the video start, how long did you watch the video.  This information may be used for our own marketing purposes as well.  The Company does not share this information with any third party and is retained only as long as necessary for our own marketing purposes or as required by law.

In addition, we collect information about your mobile device, including the Operating System, type of mobile device, and mobile device ID.  This information is used to identify the user for contests, discounts, prizes, and the like.  This information is used only to identify the user for contests, discounts, and prizes as described above.  For example, the mobile device ID and user location (see location data collection below) can be used to identify a specific individual; the specific identified individual may receive a special video with information regarding a prize that individual will receive.  The Company does not share this information with any third party and retains this information only as long as necessary to award the prize to the individual or as required by law.

In addition, we collect location data, such as global positioning system (GPS) location data.  The location data is used to: (1) determine user location to facilitate the selection of location-specific videos; and (2) determine user location for contests, discounts, prizes, as described above.  Location data for purpose (1) above is not stored and is retained only as long as necessary to identify the location-specific video.  Location data for purpose (2) above is retained only as long as necessary to award the prize to the individual or as required by law.  The Company does not share location data with any third party.

Much of this information is collected through cookies, web beacons, and other tracking technologies, as well as through your web browser or device.  The tracking technologies employed when you use our Services may be first-party or third-party.

Among the tracking technologies we use is Google Analytics.  Google Analytics help us analyze how users interact with and use the Services, compile reports on the Services’ activity, and provide other services related to our Services’ activity and usage. Your browser or device may include “Do Not Track” functionality. At this time, the Company does not respond to browser “Do Not Track” signals. 

INFORMATION SHARING AND DISCLOSURE

The Company uses and shares your information in the following circumstances:

  • protect the Company’s rights or property.

We routinely destroy information that is no longer required for the purposes described herein, in accordance with applicable laws.

Our Services are based in the United States.  If you are visiting from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your information to the United States and processing globally.  By providing your information, you expressly consent to any transfer and processing in accordance with this Privacy Policy while acknowledging that privacy laws in the United States may be different, and in some cases, less protective, than those in effect in your jurisdiction.

If you are a resident of the EEA or Switzerland, the following information applies.

Purposes of processing and legal basis for processing: As explained above, we process personal data in various ways depending upon your use of our Services.  We process personal data on the following legal bases: (1) with your consent; (2) as necessary to perform our agreement to provide Services; and (3) as necessary for our legitimate interests in providing the Services where those interests do not override your fundamental rights and freedom related to data privacy.

Right to lodge a complaint: Users that reside in the EEA or Switzerland have the right pursuant to the General Data Protection Regulation (GDPR) to lodge a complaint about our data collection and processing actions with the supervisory authority concerned. We and our affiliates, licensors and content providers are the owners of all the trademarks used on the website. Third parties are not allowed to use and apply any of the trademarks, logos and identifying marks without our express written consent.

We may revise this Privacy Policy from time to time.  Changes to this Privacy Policy are effective as soon as they are posted to the Services or made available as an update to the app in the app store.  Your use of the Services signifies your acceptance of this Privacy Policy.  If you do not agree to the terms of this Privacy Policy, please do not use the Services.
